Definitions

Mews: A specialized system for storing and processing data about rentals, tenants, and guests, as well as a service for payment of reserved rooms (https://www.mews.com/), hereinafter referred to as the "Intermediary."

Duve Application: Software used by LUX Hotel, providing the tenant with personal access to the rented room via digital keys and additional services (https://duve.com/hotel-guest-app/), hereinafter referred to as the "Application."

Pet: Any animal brought into the room, apartment, or hotel premises by the Tenant, Guest, or any person connected to the reservation.

Parties

Landlord: LUX Hotel, hereinafter referred to as the "Landlord."

Tenant: The consumer who makes the reservation and subsequently rents the room, hereinafter referred to as the "Tenant."

Guest: The consumer who uses the rented room throughout the rental period, hereinafter referred to as the "Guest."

The Tenant and Guest may be different individuals in cases where the reservation for the Guest is made by another person.

Agreement

The agreement consists of these terms and conditions, information provided by the Intermediary, and any specifically agreed terms between the parties at the time of booking.In case of conflict between the stated information, specifically agreed terms between the parties at the time of booking shall take precedence, as long as they do not conflict with legal provisions.

Specifically agreed terms between the parties are only valid if confirmed by the Landlord in written or electronic form. In other cases, fulfillment of the conditions cannot be guaranteed.

These terms and conditions come into effect immediately after a successful reservation via the Intermediary.

Liability

The Landlord is not liable for loss or damage to personal property belonging to the Tenant or Guests.

Responsibility for compliance with this agreement rests with both the Landlord and the Tenant. The Tenant has full responsibility for the Guests and for ensuring that the agreement is complied with by the Guests.

The Tenant is responsible for damage to the room or its contents that occurs during the entire stay in the room.

The Tenant is also responsible for any damage, extra cleaning, odor removal, disturbance, allergy-related cleaning, or other costs caused by pets brought by the Tenant, Guest, or any person connected to the reservation.

The Tenant is also responsible for any extra cleaning, disinfection, odor removal, replacement of bed linen, towels, mattresses, pillows, duvets, furniture, inventory, loss of revenue, security costs, or other documented costs caused by prohibited use of the room, unlawful activity, unauthorized commercial activity, adult-oriented or explicit content production, paid intimate services, escort-related activity, or other breach of these Terms and Conditions.

Reservation

All reservations are subject to availability. Any room belonging to the Landlord that can be reserved may be rented at any time and for any period, provided that the room is available during the stated rental period.

The Tenant is obliged to provide accurate and up-to-date information about themselves and the Guests when booking.

Room reservations are made via the Intermediary's reservation form.

A valid credit or debit card is required to confirm the reservation. Separate agreements take precedence over credit or debit card requirements.

In case of errors in the reservation confirmation, receipt, or the already created reservation form, we reserve the right to correct the error as soon as it is discovered, in accordance with our internal policy for changes and cancellations.

We do our very best to fulfill special requests specified in your reservation. However, such requests cannot be guaranteed unless confirmed in writing by us.

Check-in

Access to the room is granted through a digital check-in process via the Application or by creating a physical card at the check-in kiosk in the lobby.

The Tenant must complete the check-in process before access to the room can be granted.

A valid identity document from the Tenant must be uploaded through the Application during check-in, and it must match the name stated in the reservation. Alternatively, the number of the identity document can be used when checking in through the check-in kiosk in the lobby.

The main guest must be at least 18 years old to register the check-in.

Payment

Payment for the reservation must be completed before check-in.

The Landlord or Intermediary accepts common credit and debit cards for payment.

All payments are processed in Norwegian kroner (NOK). Any interest, fees, taxes, or costs associated with payment in another currency and its conversion to Norwegian kroner are the Tenant's responsibility, provided that such payment is possible.

All additional costs incurred during the stay must be paid during or no later than at the time of check-out, including those that may arise after departure, such as extra cleaning or damage to the room's contents. This applies unless otherwise agreed in writing.

The additional pet accommodation fee must be paid before check-in, unless otherwise agreed in writing.

Additional costs caused by prohibited use of the room, extra cleaning, disinfection, replacement of bed linen, towels, mattresses, pillows, duvets, furniture, inventory, damage, security call-out, or loss of revenue may be charged after check-out if such costs are discovered after departure.

The prices stated for room rental or other additional costs in the Application, Intermediary, or in confirmation from the accommodation represent the total amount to be paid by the buyer. This price includes all taxes and necessary fees to cover the full cost.

Failure to pay for the rent on the check-in day will result in cancellation of the reservation without further action from the Landlord's side.

Use of the Room

The room is intended only for registered Tenants and/or Guests. Unauthorized guests and consumers are not permitted. In case of violation, we reserve the right to ask the Guest to leave the premises. If the Guest refuses to comply with the request, we have the right to call security personnel. All costs associated with security and call-out shall be fully covered by the Guest.

The room is provided for private accommodation purposes only. The room may not be used for commercial activities, professional services, meetings with clients, events, filming, photography, content production, live streaming, advertising, or any other non-accommodation purpose without the Landlord's prior written approval.

It is strictly prohibited to book, use, or allow the room, apartment, hotel premises, or common areas to be used for paid intimate services, escort-related activity, commercial companionship involving intimate services, arranging appointments for such services, or any similar activity that is unlawful, unsafe, unhygienic, or incompatible with the ordinary use of hotel accommodation.

It is strictly prohibited to book, use, or allow the room, apartment, hotel premises, or common areas to be used for the production, filming, photography, recording, live streaming, distribution, or publication of adult-oriented, explicit, or intimate content, whether commercial or non-commercial, without the Landlord's prior written approval. The Landlord may refuse such approval at its sole discretion.

This clause does not apply to ordinary private and lawful conduct between registered adult guests staying in the room, provided that such conduct is not commercial, filmed, advertised, distributed, disturbing, unsafe, unhygienic, or otherwise in breach of these Terms and Conditions.

If the Landlord has reasonable grounds to believe that the room has been booked or is being used for prohibited purposes under this clause, the Landlord may refuse check-in, cancel the reservation, terminate the stay, deny access to the room, remove access to digital keys, contact the relevant booking platform, contact security personnel, and, where appropriate, contact the police or other relevant authorities.

Violation of this clause may result in eviction without refund, subject to mandatory Norwegian law and any applicable third-party booking platform rules.

The Tenant is fully responsible for any costs caused by breach of this clause, including but not limited to extra cleaning, disinfection, odor removal, replacement of bed linen, towels, mattresses, pillows, duvets, furniture, inventory, loss of revenue due to the room being taken out of service, security call-out costs, and any other documented costs incurred by the Landlord.

Accommodation with pets is allowed only if the Landlord has been informed in advance before check-in and has confirmed pet accommodation for the specific reservation.

Pets are subject to an additional pet accommodation fee for the stay. The fee must be paid before check-in, unless otherwise agreed in writing.

After approval and payment, a specially adapted pet-friendly room will be assigned, subject to availability.

If the Landlord has not been informed in advance that a pet will be brought, or if the applicable pet accommodation fee has not been paid before check-in, the Landlord has the right to refuse check-in and deny access to the room.

The Tenant is fully responsible for the pet during the entire stay, including any damage, noise, disturbance, extra cleaning, odor removal, allergy-related cleaning, or other costs caused by the pet.

Smoking is strictly prohibited inside the room. Smoking is only allowed in specially designated areas outdoors unless otherwise agreed.

Cancellation and Refund

Cancellation of the reservation must be done by contacting us directly at stay@luxhotel.no.

Cancellation is possible no later than 24 hours before the planned check-in date, if the reservation allows cancellation.

Additional cancellation rules and any applicable fees are specified during the reservation in separately agreed terms.

Refunds, if applicable, will be processed in accordance with our internal cancellation policy.

The Landlord may cancel a reservation before check-in, refuse check-in, relocate the Tenant or Guest to another room, or terminate an ongoing stay if the Landlord is unable to provide or continue providing the booked accommodation in a safe, lawful, hygienic, or operationally reasonable manner.

This may include, but is not limited to, force majeure events, natural disasters, fire, smoke, water damage, flooding, power failure, heating failure, cooling or ventilation failure, plumbing issues, lock or access system failure, elevator failure, pest infestation, hygiene or infection-control concerns, extreme indoor temperature, excessive heat or cold in the room, emergency maintenance, building-related issues, security concerns, fire-safety concerns, instructions from public authorities, police or municipal authorities, legal restrictions, overbooking, system errors, channel manager errors, availability errors, pricing errors, payment issues, suspected fraud, invalid or incorrect guest information, unauthorized guests, unauthorized pets, or reasonable suspicion that the reservation is intended to be used in breach of these Terms and Conditions.

If the Landlord cancels the reservation before check-in because the accommodation cannot be provided and the cancellation is not caused by the Tenant or Guest, the Tenant will receive a full refund of all amounts paid for the cancelled reservation.

If the Landlord terminates an ongoing stay because the accommodation can no longer be provided and this is not caused by the Tenant or Guest, the Tenant will receive a refund for unused nights and any prepaid unused services.If cancellation, refusal of check-in, or termination of stay is caused by breach of these Terms and Conditions, incorrect or misleading information, suspected fraud, unlawful activity, prohibited use of the room, disturbance, damage, unauthorized guests, unauthorized pets, or other circumstances caused by the Tenant, Guest, or persons connected to the reservation, refund, if any, will be handled in accordance with the applicable booking terms, these Terms and Conditions, mandatory Norwegian law, and any applicable third-party booking platform rules.

Where reasonably possible, the Landlord may offer alternative accommodation, another room, another room category, or alternative dates. The Tenant is not obliged to accept such alternative arrangements unless otherwise agreed.

For reservations made through third-party booking platforms, including but not limited to Booking.com, Expedia, and other online travel agencies, cancellation, refund, relocation, guest communication, and any applicable fees may also be subject to the rules and procedures of the relevant third-party booking platform.

The Landlord is not liable for indirect losses, travel costs, replacement accommodation, loss of opportunity, inconvenience, or other costs connected to cancellation, refusal of check-in, relocation, or termination of stay, except where mandatory Norwegian law provides otherwise.

Nothing in this clause limits any mandatory rights the Tenant or Guest may have under applicable Norwegian law.

Security and Protection

Guests are responsible for securing access to the Application.

Guests must comply with all safety and protection rules provided by the hotel.

Guests are obliged to familiarize themselves with the fire instructions stated in the Application and study the evacuation routes presented on the main door of each room.

House Rules

Guests must comply with the hotel's house rules, which are available in the Application or stated on third-party channels.

Violation of this agreement or safety and protection rules may result in eviction without refund of the payment.

Violation of the rules regarding pets, prohibited commercial use, paid intimate services, escort-related activity, adult-oriented or explicit content production, unlawful activity, unauthorized guests, or other prohibited use of the room may also result in refusal of check-in, cancellation, eviction, denial of access to the room, and additional charges, subject to mandatory Norwegian law and any applicable third-party booking platform rules.

Check-out

Check-out must be completed before 11:00 AM on the day of departure.

Late check-out must be agreed in advance with the Landlord and may incur additional costs.

Privacy

Personal information about the Guest is collected and processed in accordance with our privacy policy.

All information about the Tenant is processed, stored, and protected in accordance with the privacy policy of LUX Hotel, as well as the privacy policies of Mews (https://app.mews.com/Platform/Document/PrivacyPolicy) and Duve (https://duve.com/privacy-policy/).

Changes to Terms and Conditions

These terms and conditions may be updated periodically, and guests are responsible for staying updated. This agreement may be amended from time to time. All Tenants will be notified via the email address provided at the time of booking about this. If contact with the Tenant is not possible due to errors in the contact information, the Tenant is responsible for staying updated. The tenant is also responsible for informing guests related to their rental about any changes to the agreement. The landlord notifies affected reservations of changes to the terms.

Governing Law

These terms and conditions are subject to Norwegian law. By using the services of our apartment hotel and completing the digital check-in process for guests, you confirm that you have read, understood, and accepted these terms and conditions. If you do not accept the terms, we ask you to refrain from using our services.
